04 Sep European courts prohibit Booking.com’s rate parity clauses
Swedish Patent and Market Court is the last court to forbid rate parity clauses
The tide is turning all across Europe: Last July 24, the Swedish Patent and Market Court forbid Booking.com’s from imposing rate parity clauses in its contracts with hotel beginning October 20, 2018.
This decision followed shortly after the Belgian Federal Parliament voted into law, unanimously, last July 19, a proposition banning rate parity clauses from contracts between any and all OTAs and tourist accommodation providers.
Austria, France, Italy and Germany have also banned rate parity clauses, in recognition of their uncompetitive nature.Learn more
